Unlike the consumer class action which was not certified in a parallel case against Apple, the judges certified one against Google regarding dominant platform in a monopolization case. The case against Google seems to go to trial in November 2023.
Google has appealed the class cert decision to the Ninth Circuit, which has accepted the appeal and scheduled a hearing date.
As a result, the jury won’t hear about classwide damages at the trial. Instead, the trial will focus on liability and damages for the states suing Google. Depending on how the Ninth Circuit rules, the class might have to pursue damages claims individually.
